Overlook Privacy Policy
This document is the Overlook, LLC ("Overlook") Privacy Policy. Overlook encourages you to read this Privacy Policy so that you understand what information we collect about you and how we use that information. By using the web sites of Overlook, which are currently located at www.overlook.tv, www.creepster.tv, www.wushumaster.tv, www.kartoons.tv, www.veryfunny.tv and any web site, web page or pages that are controlled and maintained by Overlook and that are accessed through any such web site (collectively the "Web Site"), you agree to this Privacy Policy, as it may be amended from time to time. If you do not agree to this Privacy Policy, please do not use the Web Site. Overlook reserves the right to make changes to this Privacy Policy. We will provide notice to you of any substantial changes by any reasonable means, including sending an email to the most recently updated address in your Account and/or posting such notice and the amended policy on the Web Site. Your continued use of the Web Site following changes to this Privacy Policy will mean that you accept and agree to the changes and that any information collected or provided after such change will be governed by the updated Privacy Policy.
WEB SITE
There may be other versions of the Web Site that are co-branded by both Overlook and Overlook affiliates. The Web Site is owned and maintained by Overlook, LLC. Additional information about Overlook is available on the Web Site. Please note that the Web Site may contain links to other web sites that are not controlled by Overlook and that may or may not be co-branded by Overlook. All such other web sites are likely to have their own privacy policies that may be completely different from Overlook's Privacy Policy. You use any such third party web site at your sole risk.
INFORMATION WE COLLECT
As a visitor to the Web Site, you can browse many of the web pages on the site without having register with Overlook or provide any personal information; however, before accessing audio, video or any other content offered on or through the Web Site ("Content"), you may be required to create an account ("Account") for yourself. In order to create an Account, you must provide Overlook with your name, email address and select a password. You may also provide a company name and other information, if applicable. In order to access content for which a fee is charged, you must also provide Overlook with other personal information, such as a credit card number, billing address and phone number, and your age. You may elect to also provide optional information about yourself to Overlook, such as occupation, gender, marital status and so on.
Overlook maintains a history of your Content selections. You may also provide information about personal preferences. This information is used primarily by Overlook to service you better. Overlook may, for example, use this information to suggest Content that you may be more likely to enjoy. Overlook may also use this information to identify end users to whom Overlook will make special offers.
TO WHOM DO WE SEND YOUR INFORMATION?
Although you are not required to enroll in order to access the Web Site, Overlook may still collect information about you, even though the information is not personally identifiable. Overlook may collect information about your Internet browser, type of computer operating system, IP address, connection speed, Internet service provider, geographic location and the web site or advertisement from which you linked to the Web Site. For registered users of our service, we may also collect information about transactions with us, our affiliates, or others, as well as site usage patterns, such as the pages on the web site visited, searches conducted and the amount of time you have spent on our web site. Any correspondence that you send to Overlook may also be retained. The extent to which Overlook uses this information and distributes it to third parties is described below.
TECHNOLOGIES USED BY OVERLOOK
Overlook utilizes a standard Web technology called "cookies", which are small files stored by most Web browsers. Cookies enable the Web Site to automatically recognize you for subsequent visits to the site. Cookies also enable Overlook to keep track of which pages you visit and which ads you click on. Most Web browsers allow users to erase all cookies stored by the browser, or even block all cookies from being stored in the future; however, users that set their browsers to block all cookies may not be able to access content from Overlook. If you erase the Overlook cookies, then you may have to log in again on subsequent visits to the Web Site in order for Overlook to identify you.
THIRD PARTY SITES
Overlook may also provide links to third party sites. These third party sites may also collect information from you and may share that information with Overlook. By using the Overlook service, you agree to allow Overlook to receive and use any information, except for credit card information, that you may provide to third party sites or other sites, under the same terms as if you provided the information directly to Overlook. Whether or not that third party site actually shares your information and to what extent they do share it with Overlook will depend on such third party's agreement with us and the privacy policy of such third party as disclosed to you.
WHAT OVERLOOK DOES WITH YOUR INFORMATION
In order to keep you informed about Overlook services, we may send electronic mail messages and announcements to the email address you provide when you set up your Account. You also have the option of joining our mailing list to receive additional information about Overlook offerings and offerings from Overlook affiliates. Overlook may give you the option to specify whether or not Overlook or our affiliates should be allowed to send mailings directly to you. At any time, you can change your personal options by accessing your Account through the Web Site.
Overlook collects non-personally identifiable information about users and may share this information with affiliates and advertisers to help tailor our offering to better meet customer needs and preferences. Other than as stated in this Privacy Policy, Overlook does not share personally identifiable information about users with any third party other than those parties needed in order to process credit card transactions, and we do not allow such parties processing your transactions to use such information further. Overlook takes reasonable steps to protect personally identifiable information that users choose to provide, but Overlook accepts no liability for its failure to protect such information.
If you make a purchase from an Overlook affiliate through the Web Site, then Overlook may provide certain personal information about you to the affiliate. When you access the Web Site via a version of the site that is co-branded with an Overlook affiliate, then Overlook may share any personal or non-personal information about you with the affiliate. Any use of the information by the affiliate will be subject to this Privacy Policy and the affiliate's privacy policy, but in the event of a conflict in their respective terms, this Privacy Policy shall control.
Overlook works with third parties that provide us with various services, such as Web hosting, credit card processing, physical fulfillment, data analysis, customer service and so on. Personal information, including financial information, may be shared with these third parties for the purpose of providing services to users. Overlook seeks to gain the agreements of these service providers to maintain the confidentiality obligations described in this Privacy Policy. Overlook will not otherwise provide or sell your personal information to third parties without your consent.
PERMITTED DISCLOSURES
Entities into which Overlook is merged, or to which our assets, Web Site or operations have been transferred or sold, will be able to use your personal information under the terms of this Privacy Policy. We also reserve the right to disclose personal information to third parties when we believe in good faith that the law requires it; to enforce our Terms of Use as set out on the Web Site or the EULA (both of which also apply to your access and use of our services); to protect the rights, property, safety, or security of Overlook, its users, its content providers, or the public; in order to respond to an emergency; and as otherwise stated in this Privacy Policy.
SECURITY
Overlook uses reasonable security technologies and procedures to protect the data that resides on our servers; however, like virtually all Internet-based services, Overlook cannot guarantee the security of our servers because no technology or procedure is foolproof. Although Overlook employs a standard technology known as SSL (secure sockets layer) to protect user information while in transmission over the Internet, it is possible that someone could intercept this information. SSL is used by the Web Site when it exchanges sensitive information, such as credit card numbers, with standard Web browsers. Each user is responsible for maintaining the secrecy of the passwords that he or she selects, as well as other information that make up his or her Account. Overlook advises that users select non-obvious passwords in order to help protect their privacy. You should also remember to log off from the Overlook service, exit your browser window when you are finished with using the service. You are also responsible for maintaining the security of your own computer hardware, which will help prevent unauthorized access. The Overlook Privacy Policy does not extend to any other services, sites, organizations and/or technologies that are not under the control of Overlook. Furthermore, the Overlook Privacy Policy cannot be applied in a manner that is contrary to any applicable law or government regulation.
ACCESS BY CHILDREN
The Web Site is intended for use only by adults 18 years of age or older. If a parent or guardian discovers that their child has accessed Overlook and/or has provided personal information to Overlook, then, upon the parent's or guardian's request, Overlook will make a reasonable effort to delete the child's information from Overlook's database. To request the deletion of information, please send such request to help @ overlook.tv (without the spaces) and please remember to include the child's correct email address that was entered so that we may locate the child's information in our database.
HOW TO REVIEW, UPDATE OR DELETE YOUR ACCOUNT
The Web Site provides functions that enable you to view, update or delete your account information. It is your responsibility to ensure that your own Account information is complete and up to date. In order to update your Account information, please access your Account through the functions provided on the Web Site and make the desired change.
